1. GENERAL PROVISIONS
This Regulation establishes the general conditions and requirements for the processing of personal data of customers/consumers of "AMARYNE BIOLABS" SRL by the advertising and PR department.
This document (together with all documents referred to herein) sets out the terms and conditions governing the use of the website www.21collagen.ro, (hereinafter referred to as "www.21collagen.ro"/"the Site") and the placing of product orders through this Site (hereinafter referred to as the "Terms").
Any product or service offered through this Site is addressed to individuals who may purchase/access them for their own use without the purpose of resale, hereinafter referred to as "Client"/ "Customers". "AMARYNE BIOLABS" SRL has no obligation or liability resulting from the successive sales of products and/or services made by Customers.
Our Terms and Privacy Policy (collectively, the "Privacy Policies") require that you read them before using the Site and placing an order through it. By accessing and using this Site and/or placing an order through it, you expressly acknowledge that you are bound by the Terms and Privacy Policies and agree to abide by these Terms and Privacy Policies.
If you do not fully accept the Terms and Privacy Policy, do not use this Site. The Company reserves the right to revise these Terms without prior notice. The terms specified on www.21collagen.ro will apply at the time of placing the order.
Any questions regarding the Terms or the Data Protection Policies can be addressed at any time to hello@21collagen.ro. The Contract (as defined below) may be concluded if express agreement is expressed in this regard.
2. OPERATOR SITE
The operator of the website www.21collagen.ro is the company "AMARYNE BIOLABS" SRL, organized under Romanian law, headquartered in Bucharest, Sector 1, Strada BERZEI no. 20, MANSARDA, fiscal identification code 1002600033793, postal code 010251, registered in the trade register with no. J40/22731/2023.
3. CUSTOMER DATA
The information or personal data that the Client provides will be processed in accordance with the Data Protection Policies. By using this Site and/or placing an order for products through www.21collagen.ro, the Customer expressly and unequivocally expresses his consent to the processing of this information and data and declares that all information and data he provides are true and accurate and that he has obtained the prior written consent of the owner of the information and/or data, in the event that the information and data provided through the Site belong to a third party.
The following categories of personal data are processed:
a.last name, first name;
b.mobile phone number;
c.email address;
d. address (homes/residences);
The personal data subject to this Regulation will be stored by the responsible person within the enterprise, so as to allow the identification of the data subjects strictly for the period necessary to achieve the purposes for which the data are processed, and upon expiry of that period, the records will be destroyed/deleted, depending on the medium on which they were made. In the case of express obligations provided for by law, they may remain in storage, receiving the status of an archival document.
Any use of personal data for purposes other than those mentioned above is prohibited.
The processing of information containing personal data in the records system of the online store www.21collagen.ro is carried out during the contractual relations between "AMARYNE BIOLABS" SRL and the Client/buyer.
4. USE OF THE SITE
By using this Site and/or placing any product order through it, the Customer undertakes:
• Use this Site exclusively to submit legitimate inquiries or place legitimate orders.
• Not to place any false or fraudulent order. If there are reasonable grounds to believe that such an order has been placed, the Company reserves the right to cancel the order and inform the competent authorities accordingly.
• Provide a correct and accurate email address, postal address and/or other contact details. The Client also consents to the Company using this information to contact the Client in the event of such need (see Privacy Policy).
If all the required information is not provided, there is a possibility that the order will not be completed.
By placing an order through the Site, the Customer declares that he is over 16 years of age and has the legal capacity to enter into binding contracts.
Customer Account
Each Client has the opportunity to create a Client Account on the www.21collagen.ro platform, becoming a member of www.21collagen.ro and benefiting from all the advantages of account registration.
The Client is solely responsible for maintaining the confidentiality and security of the account. The Client is also solely responsible for all activities that occur through or in connection with the account and agrees to immediately notify "AMARYNE BIOLABS" of any unauthorized use of the account or any other breach of security. "AMARYNE BIOLABS" SRL will not be liable for damages resulting from unauthorized use of the account.
Fraud
Attempts at unauthorized access to the Site, including but not limited to any attempt to access the personal data of another Client, to modify the content of the www.21collagen.ro site or to affect the performance of the server on which it runs, will be considered attempts to defraud the www.21collagen.ro site and will be reported to the competent authorities, initiating criminal investigation against the person or persons who attempted this.
Communication
Opinions or addresses containing insults or inappropriate language will be excluded from the site or ignored.
By using the contact form or service present on the site, the Client allows "AMARYNE BIOLABS" to contact him by any available means including electronic means.
Partial or full completion of the contact form and its submission does not in any way represent a commitment on the part of "AMARYNE BIOLABS" to contact the Client.
Cookies
The website www.21collagen.ro uses its own cookies and cookies installed by third parties, such as Google, to provide the best possible experience on the website. The cookies used on this website provide valuable feedback and support the improvement of the online experience.
An "Internet Cookie" is a small file, consisting of letters and numbers, that will be stored on a user's computer, mobile terminal or other equipment from which the Internet is accessed. It is not a virus and does not request personal information in order to be used.
Cookies provide users with a pleasant browsing experience and support the efforts of many websites to provide comfortable services to users, as they store important information that improves the Internet browsing experience (eg: language settings in which a site is accessed; keeping a user logged in; online banking security; keeping products in the shopping cart, etc.)
Some browsers offer the ability to control cookies, meaning they can be disabled. However, it should be noted that disabling cookies may also reduce the quality of visits to the www.21collagen.ro website.
5. ORDER
The order is placed through our ordering system, by completing the order form. All orders are subject to acceptance by us, and we will confirm acceptance by sending you an e-mail confirming the shipment of the product ("Shipping Confirmation"). By completing the order, the Customer agrees that all data provided by him, necessary for the purchase process, are correct, complete and true at the date of placing the order.
If a Client modifies their personal data, using the forms available on the Site, all ongoing contracts existing at that time, retain the data defined/accepted by the Client prior to the time of modification.
All product orders are subject to the availability of the respective products in stock. In this regard, in the event that supply difficulties arise or if the products are no longer in stock.
"AMARYNE BIOLABS" SRL reserves the right to refuse total or partial acceptance of an order placed by the Customer, without any subsequent obligation of either party to the other or without either party being able to claim damages from the other, in the following cases:
1. The products are out of stock;
2. Payment is not completed;
3. The data provided by the Client on the Site is incomplete or incorrect;
4. The Client's activity on the Site may and/or cause damage of any nature to "AMARYNE BIOLABS" and/or its partners;
5. There are one or more confirmed and uncollected orders.
We reserve the right to remove any product from this Site at any time, in our sole discretion, and/or to remove or modify any offer, material or information on this Site. Although the Company makes every effort to always process all orders placed, there may be exceptional circumstances that require us to refuse to process an order after sending the Order Confirmation message and we reserve the right to do so at any time. The Company will not be liable to the Customer or any third party for removing any product from this Site, for removing or modifying any material, offers or content on this Site or for not processing an order after sending the Order Confirmation message.
"AMARYNE BIOLABS" will notify the Customer about the unavailability of an ordered product, the Customer having the option to accept or refuse the partial order. For information related to the order, the telephone number +40 749 280 717 can be called, Monday to Friday, between 8 am and 4 pm, or an email can be sent to hello@21collagen.ro.
Orders placed Monday through Friday will be processed within 24 hours of being placed, and orders placed on Saturday and Sunday will be processed every Monday. Should these dates change, the new deadlines will be announced both on the Site and in electronic communication.
6. CONCLUSION OF THE CONTRACT
The information provided in the Terms and the data contained in this Site do not constitute an offer to sell, but an invitation to offer. There will be no contract between the Client and "AMARYNE BIOLABS" SRL in relation to any product until the order is expressly accepted by the Company. If the offer is not accepted and funds have already been withdrawn from the Client's account, these will be fully refunded.
The contract for the purchase of a product ("Contract") is concluded only upon the transmission of the Dispatch Confirmation.
7. PRODUCT PRICES, SPECIAL OFFERS, DISCOUNT CODES
The price of each product will be as stated on the Company's Website, unless there is an obvious error. The Company undertakes to correctly indicate the prices on the Website, but errors are allowed. If a price error is discovered for any product(s) in the Customer's order, the Customer will be informed as soon as possible and will be given the option to reconfirm the order at the correct price or cancel it. If the Customer cannot be contacted for reasons not attributable to the Company, the order will be considered canceled and, if the product(s) has already been paid for, the payment will be refunded in full.
The Company has no obligation to sell any product at an incorrect lower price (even if the Customer has received the Shipping Confirmation), if the pricing error is obvious, unmistakable and could have been reasonably identified by the Customer as an error.
The prices displayed on the Site include VAT, but do not include delivery costs, which will be added to the total outstanding amount.
Prices and offers may be revised at any time without prior notice, but (with the exceptions noted above), any potential change will not affect any order for which an Order Confirmation has already been sent prior to the price change.
Different types of discounts are offered in the online store. Any discount code can be used only once for an order , Discount codes do not apply to existing offers on the site.
Promotions and discount codes cannot be combined with other promotions and discounts existing in the "21Collagen" store.
8. PAYMENT OF PRODUCTS
After the Customer has selected all the products he/she wishes to purchase by adding them to the shopping cart, the next step is to complete the order and make the payment. To do this, the Customer must follow the steps in the purchase process, completing or verifying the information requested at each step. Moreover, throughout the purchase process, before making the online payment, the Customer can modify the order data. Also, if the Customer is a registered member, a history of all orders placed by him/her will be available in the "My Account" section.

Payment in installments (partners - Klarna, PayPo)
Payment is made in complete safety conditions, without any commission. Card data is processed by the payment processor BANCA COMERCIALA ROMANA SA, and www.21collagen.ro does not request or store any details regarding the Customers' card. In order to correctly complete the transaction, the card code (all digits in the four groups on the front of the card), the expiration date and the last three digits on the back of the card inscribed on the signature strip (depending on the type of card, these may be missing) must be provided.
Credit cards are subject to validation and authorization checks by the issuing institution. If the Company does not receive the necessary authorization, it assumes no liability for the delay in the delivery of the ordered products or, as the case may be, their non-delivery and will no longer be able to conclude the Contract with the potential Client .
Klarna
When you choose the "Pay later in 3 installments" option, a credit agreement is concluded between you and Klarna, based on which a credit is granted for your purchases, to be repaid in 3 equal installments, within a maximum repayment period of 3 months, and for which no costs are paid, provided that you comply with the automatic payment schedule.
"Pay later in 3 installments" is a payment option that is granted to you to credit you. The amount credited will correspond to the total amount paid for the purchase of goods on www.21Collagen.ro.
PayPal
If you choose the PayPo option , a credit agreement is concluded between you and PayPo , based on which a credit is granted for your purchases, which are to be reimbursed within 30 days.
PayPo is a payment option that is granted to you to credit you. The amount credited will correspond to the total amount paid for the purchase of goods on www.21Collagen.ro.
9. DELIVERY
Subject to the provisions of Article 5 above regarding the availability of products, except in cases where there are extraordinary circumstances, the Company will make every effort to complete the order with the product(s) listed in the Order Confirmation by the date specified in the said Shipment Confirmation or, if the estimated delivery date is not specified, within the estimated time indicated when selecting the delivery method and, in any case, within a maximum of 30 calendar days from the date of the Shipment Confirmation.
However, delays may occur due to reasons such as unforeseen circumstances or the delivery area.
If, for objective reasons, the Company cannot meet the delivery date, the Customer will be informed of this situation and will be given the option to maintain the order with a new delivery date or to cancel the order with a full refund of the amount paid. Please note that the Company does not deliver on weekends.
For the purposes of these Terms, "delivery" is deemed to have taken place or the order is deemed to have been "delivered" when the Customer or a third party designated by the Customer takes physical possession of the products, as evidenced by the signature of receipt of the order at the agreed delivery address.
If the product order does not reach the Customer within the estimated delivery time, the Customer may contact the Company at the telephone number For any questions regarding the return process or for further clarification, please contact us at the email address support@21collagen.ro or at +40 749 280 717 . We are available from Monday to Friday, between 10:00 and 16:00, to assist you. or email address: hello@21collagen.ro.
In the case of delivery by courier, if the Customer is not found at the mentioned address within the mutually agreed upon time frame, the courier will return 2 more times after managing to contact him, and if the third delivery fails, the order will be canceled and the product returned to the headquarters of "AMARYNE BIOLABS" SRL. In this case, the delivery address of the package will be confirmed together with a "AMARYNE BIOLABS" SRL customer advisor by phone or e-mail.
If the packages show signs of damage (torn, opened package, etc.), the Company recommends that the Customer refuse to pick up the package and communicate this to the email address hello@21collagen.ro.
After opening the package, if it contains damaged products, or they do not correspond to the invoiced products, it is recommended to contact the Company within 24 hours of receiving the package at the email address hello@21collagen.ro with an attached photo of the products or package.
"AMARYNE BIOLABS" SRL is not responsible for product defects occurring during handling or transportation by the courier.
If the delivery and/or order initialization deadlines cannot be met, "AMARYNE BIOLABS" SRL will notify the Customer of these aspects and of the estimated delivery completion date, without either party being able to claim damages from the other regardless of the situation that generated the delay.
Delivery of products can only be made in Romania. Delivery method: Courier
10. TRANSFER OF RISK AND TITLE TO THE PRODUCTS
All risks related to the products (including loss and damage) will pass to the Customer from the moment of delivery, when the Customer or a third party designated by the Customer, other than the courier, takes physical possession of the products.
Title to the products will only be transferred to the Customer upon full payment of all amounts due for the products, including delivery costs, or upon delivery (as defined in Article 9 above), if this occurs at a later date. Legal title to the products will immediately revert to "AMARYNE BIOLABS" SRL if any such payment is refunded to the Customer.
11. PRODUCT RETURN POLICY
Law no. 363/2007 on the Protection of Consumers in Commercial Transactions, Article 9, Paragraph (1): Consumers have the right to return products and obtain a refund within 30 days, if the products are unused and unopened. This means that food supplements cannot be refunded after they have been opened.
Free repair of product defects, free replacement or refund of the product value, within the warranty period or the validity period, defects that are not attributable to the consumer, is made unconditionally within a period of no more than 30 calendar days from the date of submission of the complaint by the consumer.
In the case of cosmetic products that do not comply with the prescribed or declared requirements, at the request and option of the consumer, the products are replaced or their value is refunded.
The value of the product sold is refunded immediately after it is established that it is impossible to use it, if the defect is not attributable to the consumer and if the consumer has refused to remedy or replace the product.
When refunding the product, the price of the product on the date of examination of the complaint will be taken into account - if its price has increased, and the price on the date of purchase - if its price has decreased. The price reduction for the unsuitable product is made upon agreement of the parties.
12. COMPLAINTS MANAGEMENT. WARRANTY
In case of adverse or unpleasant reactions as a result of using the products, the Customer is requested to notify the Quality Control Department of the company "AMARYNE BIOLABS" SRL within a maximum period of 14 days, providing a detailed description of the problem, accompanied by a medical evaluation. For this, it is recommended to send an email to the address support @ 21collagen.ro .
Legal guarantee of conformity
The warranty conditions are in accordance with Law No. 449/2003 on the sale of products and associated guarantees and the Law on Consumer Protection.
In case of non-conformity, it is necessary to present the non-conforming product in its original packaging, together with the related accessories and proof of purchase. If the products arrive unaccompanied by these documents, the products may be returned to the applicant/sender without the warranty being settled.
13. INTELLECTUAL PROPERTY AND COPYRIGHT
This site is protected by copyright.
All content of the website www.21collagen.ro, including texts, images, graphics, audio and video files, trademarks, service marks, industrial designs and models, trade names are the exclusive property of "AMARYNE BIOLABS" SRL and may not be reproduced, modified, transmitted, reused, appropriated, used, or used publicly or for commercial purposes, without obtaining the prior written consent of "AMARYNE BIOLABS" SRL. "AMARYNE BIOLABS" SRL is the only entity authorized to use the intellectual and industrial property rights and the publicity rights related to them, it does not grant any license, any other right than to consult the Website.
Any reproduction or representation, in whole or in part, of the site or any of its elements, regardless of the medium and regardless of the form, for other purposes, especially commercial, is expressly prohibited.

14. ASSIGNMENT AND SUBCONTRACTING
The contract concluded between "AMARYNE BIOLABS" SRL and the Client is binding on each of the parties.
The Client may not transfer, assign, pledge or otherwise alienate a Contract or any of its rights or obligations arising therefrom, without obtaining the prior written consent of "AMARYNE BIOLABS" SRL.
"AMARYNE BIOLABS" SRL may transfer, assign and/or subcontract or otherwise dispose of a Contract or any of its rights or obligations arising therefrom, at any time and for the duration of the Contract. For the avoidance of doubt, any such transfer, assignment, encumbrance or other disposition shall not affect the legal rights of the Customer as a consumer and shall not nullify, reduce or otherwise limit any warranty that has been granted to the Customer, whether express or implied.
15. NOTIFICATIONS
"AMARYNE BIOLABS" SRL may send notifications regarding the activity of the company and the Website www.21collagen.ro to the e-mail address entered in the notification subscription form, or by other means of communication. Receiving notifications requires selecting the appropriate option by completing a form by the Client via the Website www.21collagen.ro or via a campaign page of the company "AMARYNE BIOLABS" SRL, as well as unconditional acceptance of the Terms, if the Client has not already expressed this agreement.
The data taken from the Client for the purpose of sending notifications can and will be used by "AMARYNE BIOLABS" SRL within the limits of the Privacy Policy.
The Client may opt out of receiving notifications at any time by the following methods:

Using the specially designated link within the newsletter.

By contacting "AMARYNE BIOLABS" SRL, according to the contact information, without any subsequent obligation of either party to the other or without either party being able to claim damages from the other.
Opting out of receiving notifications does not imply waiving your acceptance of the Terms.
"AMARYNE BIOLABS" SRL reserves the right to select the persons to whom it will send notifications, as well as the right to remove from its database any Client who has previously expressed consent to receive notifications, without any subsequent commitment from 21Collagen or any prior notification thereof.
"AMARYNE BIOLABS" SRL will not include in the notifications sent to the Client any other type of advertising material in the form of content that refers to any third party that is not a partner of "21Collagen" at the time of sending the newsletter.
16. LITIGATION
Any relationship established by purchasing products or services through the Site is governed and interpreted in accordance with Romanian law, and the Client agrees to submit to the exclusive jurisdiction of the competent courts in Romania.
Any conflict between "21Collagen" and another party is subject to amicable settlement. If a common denominator is not reached through this method, the jurisdiction lies with the courts of Romania.
17. TERMINATION
"AMARYNE BIOLABS" SRL reserves the right to cease operation of the Site without any prior notice.
18. OTHER CLAUSES
These Terms and any document expressly referred to herein constitute the entire agreement between the Client and "21Collagen" with respect to the subject matter of any Contract and supersede any other agreement, understanding or prior oral or written arrangement between the Client and "21Collagen".
"AMARYNE BIOLABS" SRL reserves the right to make any changes to these provisions, as well as any changes to the Site/its structure, including changes that could affect the Site and/or any content without prior notification to the Client.
"AMARYNE BIOLABS" SRL cannot be held responsible for any errors that may occur on the Site for any reason, including due to changes, settings, etc., that are not made by the Site administrator.
